NETMED HELLAS SA (hereinafter NETMED) owns and operates the present site and provides through this site, the novaondemand.gr live streaming service. You are kindly requested to read carefully the following terms and conditions. It is about the definition of the terms and conditions, on the basis of which, NEΤΜED shall provide to the user the as above service.

1. DEFINITIONS

1.1. SERVICE

The provision to the user, through the use of Internet, of the possibility to watch paying a fee, through the site novaondemand.gr live streaming, live or delayed sports events and programs of sports content, the rights of which are held by NETMED.

1.2. USER

The person who is contracted via interment with NETMED, in order to have access to the SERVICE, according to the Terms and Conditions hereof.

1.3. CONTENT

The sports event or program of sports content which is provided by NETMED to the USERS within the bounds of the SERVICE’s provision.

1.4. FEE

The fee that the USER is obliged to pay to NETMED in order to acquire access to the CONTENT.

2. OBLIGATIONS OF THE USER

The use of this site and the SERVICE implies that the USER acknowledges and accepts the Terms and Conditions hereof, the effect of which commences from the time that the USER enters the site and accepts the terms of use of this SERVICE. NETMED reserves the right to change these Terms and Conditions at any time and post them online and it is the responsibility of the User to refer to the site and comply with these terms on accessing the site each time. If he continues to use this site after the as above posting of the changes, it is presumed that he has accepted these terms and conditions, as modified.

If the USER does not accept in full these Terms and Conditions, he will not have permission to access the SERVICE.

The names, images and logos included in this site and identify NETMED, its affiliated companies or third parties and their products and services are proprietary marks of NETMED, its affiliated or cooperating with it companies and/or the third parties. Nothing contained herein shall be construed as providing any license or right to any USER for the as above trade marks or patents of NETMED, its affiliated or cooperating with it companies or any third party.

All copyright, trade marks and other intellectual property rights in this site (including the design, arrangement and look and feel) as well as all material or content supplied as part of this site shall remain at all times the property of NETMED or the licensors of NETMED. The USER is entitled to make use of the SERVICE exclusively and solely for himself and any commercial use of the SERVICE is explicitly prohibited. It is explicitly prohibited to the USER to permit, with or without consideration to any third party in any manner, to copy, reproduce, post, store, distribute, transmit, broadcast, commercially exploit or modify in any way the CONTENT without NETMED’ s prior written permission.

4. PERSONAL DATA-SECURITY OF TRANSACTIONS

Any information or data the USER transmits or posts on this site are confidential. This information may be used by NETMED for the performance of its obligations against the USER, for the performance of its obligations against the Authorities and according to the Data Protection Act. The USER hereby explicitly gives his consent to NETMED for the as above uses as well as in order the latter to inform him about the offer of its new services and products.

Specifically, the USER’ s credit or debit card information collected through this website are confidential and shall be used by NETMED only for the performance of the obligations it hereby undertakes against the USER. To protect the security of the USER’s credit card information, NETMED uses the industry –standard Secure Sockets Layer (SSL) technology. Furthermore, NETMED encrypts the credit card number when it stores the order and whenever it transfers that information to the bank, to support the transaction.

5. LIMITATION OF LIABILITY

5.1. REGARDING THE FEE

The FEE and the terms of sale for the each time provided by NETMED SERVICE and the access to the CONTENT will be those in effect during the time that the USER will give the relevant order. NETMED reserves the right to change its pricing policy and it is not responsible for any sudden change of the FEE, including without limitation requiring payment by the USER for CONTENT that was previously distributed free of charge or non payment of FEE and eliminating charges for CONTENT that previously required payment of FEE. NETMED is entitled to proceed to the charging of the credit card of the USER as soon as it practicable, at the time it will select.

5.2. REGARDING THE SERVICE

The SERVICE is considered as being provided fully by NETMED, unless it is defined otherwise, from the time that the USER acquires access to any particular CONTENT by streaming, while it will be deemed that the SERVICE has been provided in full, regardless of the fact whether the USER has watched the CONTENT. NETMED shall have no responsibility to reimbursement or refund in the event that the USER is dissatisfied either with any particular CONTENT (e.g. due to mistake it ordered CONTENT other than the one that he intended to order) or with the quality of the CONTENT (e.g. the quality of video or audio), or with the delivery of the CONTENT (e.g. the speed of the connection of the USER with the servers of NETMED) or any other matters outside the control and responsibility of NETMED. The USER is not entitled to any refund or credit if he cancels the order prior to the commencement of the CONTENT, or if he fails to have access to the CONTENT, due to any reason not attributable to NETMED. Specifically, the USER is not entitled to any refund if he cannot receive the CONTENT due to a problem of his computer or due to the connection of his network or due to the connection of his computer with the servers of NETMED. In case that the USER did not receive the SERVICE and did not have access to the CONTENT, for reasons that exclusively and provenly concern NETMED, then he will be entitled to the refund of the FEE that has already paid according to the effective legislation.

5.3. REGARDING THE CONTENT

The information and the material included on this site in connection to the SERVICE and the CONTENT may contain inaccuracies and typographical errors. NETMED does not warrant the accuracy or completeness or reliability of any statement or other information displayed or distributed through the site (including, without limitation, the information provided through the use of any software). The USER acknowledges that any reliance on any such statement or information shall be on his exclusive responsibility and at his sole risk. NETMED, reserves the right, in its sole discretion, to correct any errors or omissions in any part of the site and to make changes to the site and to the materials, products, programs, services or prices described in the present site at any time, without any prior notice to the USER.

NETMED does not warrant that the functions contained in the present site will be uninterrupted or error free.

5.4. REGARDING THE WEBSITES OF THIRD PARTIES/LINKS

NETMED is not responsible for the availability or content of any third party websites or material the USER of the SERVICE accesses through its site. If the USER visits any linked site, he does so at his own risk and it is exclusively his responsibility to take all protective measures to guard against viruses or other destructive elements. NETMED does not endorse and is not responsible or liable for any content, advertising, products, services or information on or available from third party websites or material (including payment for and delivery of such products or services). NETMED is not responsible for any damage, loss or offence caused by or, in connection with, any content, advertising, products, services or information available on such websites or material. Any terms, conditions, warranties or representations associated with such dealings, are solely between you and the relevant third party-provider of the service.

6. INDEMNITY

NETMED is entitled to claim from the USER an indemnity (direct or indirect loss) in the event that itself suffers any loss or any claims of third parties arise at its expense, due to any conduct of the USER, which is related either with his entry in the website or with the use of the SERVICE in a different way than the one described herein.

7. LAW AND JURISDICTION

The present Terms and Conditions are governed and construed in accordance with the law of Greece. Disputes arising hereof shall be exclusively subject to the jurisdiction of the Courts of Greece and shall be specifically subject to the Courts of the city of Athens.
